Professional Service Mandates

As a built environment Consultant you provide services to your clients in terms of a professional services mandate contract, either your own proposal or that of your Client. Often documentation that you are tendering on is confusing making it difficult for you to gain a clear picture of your professional liability risks and potentially frustrating effective contract administration. Either of these are fundamental causes of dispute with significant time and cost implications for your professional firm.

We are able to assist you to mitigate these risks including by -
  • Creating a ‘conformed’ version of the Client’s contract that integrates some or all of the contract components into the contract general conditions giving you greater visibility for risk and opportunities assessment,
  • Providing a risk report detailing ambiguities, conflicts and specific risk issues that impact your professional liabilities and on the administration of your contractual relationships,
  • For your own proposal contracts we can review these for you, and (if required),
  • Provide draft concepts for modernising your own contract templates, to make them easier to read and understand, improve their flexibility, reusability, and effectiveness as management and partnering tools between yourself and your Clients
